Terms and Conditions of Sale

This English version is provided for convenience. In the event of any discrepancy, the French version prevails.
Article 1 — Seller identification
This website and the online shop operated under the trade name stoaTCG are published by:
RECUERO Rue Lieut. Maurice Tasse 73 6141 Fontaine-l'Évêque, Belgium
Company number (CBE): 0848012503 VAT number: BE0848012503 E-mail: info@stoatcg.be Telephone: +32 451 05 00 49
Hereinafter "the Seller" or "we".
Article 2 — Scope and acceptance
These terms and conditions govern all sales concluded remotely through the website, as well as sales made in store where reference is made to them.
Placing an order implies full acceptance of these terms. The Customer confirms having read them before validating the order. Ticking the acceptance box during checkout constitutes acceptance.
We reserve the right to amend these terms at any time. The terms applicable to an order are those in force on the day the order is validated.
A Consumer is any natural person acting for purposes outside their trade, business, craft or profession. The protective provisions set out in Articles 9 and 10 apply exclusively to Consumers.
Article 3 — Products and availability
Our products are trading cards, unopened products in their original packaging and related accessories, in Japanese, English or French editions.
Images, descriptions and illustrations are provided for guidance only. They do not bind the Seller as regards possible variations in packaging, artwork or contents decided by the publisher or manufacturer. Some images are provisional visuals supplied by the manufacturer and are identified as such.
Each item displays one of the following statuses:
In stock (no badge) — the item is physically available. It is prepared and dispatched as soon as possible.
On order — the item is not in stock but available from our supplier. It is ordered as soon as your order is received and dispatched once it reaches our premises, under the conditions of Article 7.2.
Pre-order — the item has not yet been released. Its release date is set by the publisher and communicated for guidance only. Article 8 sets out the applicable regime.
Offers are valid while stocks last, both in our own inventory and at our suppliers. Where unavailability is established after the order, Article 8.3 applies.
Article 4 — Prices
Prices are stated in euros, inclusive of all taxes, excluding delivery costs. Delivery costs are calculated and displayed before final validation of the order.
The applicable prices are those displayed at the time the order is validated. We reserve the right to change our prices at any time, without affecting orders already validated.
In the event of an obvious pricing error — in particular a price that is derisory in relation to the value of the product, or resulting from a technical fault — we reserve the right to cancel the order and refund the Customer in full, having first informed them.
4.1 Offers, promotions and undertakings
Promotional offers are valid for the period announced and while stocks last. A price or an offer applied at a given time creates no right to benefit from it later.
Oral undertakings bind the Seller only once confirmed in writing. Any special condition departing from these terms must be agreed in writing.
An item on promotion, on sale or in clearance carries the same rights as an item sold at full price, in particular as regards withdrawal and the legal guarantee.
Article 5 — Orders
The order is deemed concluded when the Customer validates payment at the end of the checkout process. A confirmation e-mail summarising the order is sent.
Before validation, the Customer is able to review the details of the order and correct any errors.
We reserve the right to refuse or cancel any order of an abnormal character, in particular where quantities are manifestly disproportionate to normal consumer use, where fraud is suspected, where a previous dispute remains unresolved, or where resale would manifestly breach our suppliers' conditions. In such cases, any sums already paid are refunded in full.
Article 6 — Payment
Payment is made online at the time of ordering, using the methods offered during checkout and operated by our payment provider Mollie.
We never have access to your full card details, which are processed directly by the payment provider in a secure environment.
The price is payable in full at the time of ordering, whatever the status of the item ordered — in stock, on order or pre-order. The Seller does not operate deposit payments.
The goods remain the property of the Seller until full payment of the price. The transfer of risk nevertheless takes place in accordance with Article 7.
Article 7 — Delivery
7.1 Areas and methods
Deliveries are made in Belgium and, where applicable, to the countries offered during checkout, by bpost or any other carrier indicated.
7.2 Dispatch time
Two successive periods must be distinguished: the dispatch time, running up to the handover of the parcel to the carrier, and the transit time, running from that handover to delivery.
The Seller commits to the dispatch time alone:
| Item status | Dispatch |
|---|---|
| In stock | within five (5) working days on average from confirmation of payment |
| On order | within five (5) working days on average from arrival of the goods at our premises |
| Pre-order | within five (5) working days on average from arrival of the goods, which follows the release date set by the publisher |
The Seller does its utmost to meet these times and keeps the Customer informed at every step: order confirmation, arrival of the goods, then dispatch together with the tracking number.
Where an order contains items of differing statuses, it is dispatched in a single shipment, at the longest applicable time, unless the Customer requests otherwise in writing. Separate shipment may incur additional delivery charges.
7.3 Transit time
Once the parcel has been handed to the carrier, the applicable transit times are those announced by the carrier chosen by the Customer at checkout — bpost or Mondial Relay depending on the option selected. Those times are available from the carrier concerned.
The Seller does not control transit and does not guarantee a specific delivery date. Any durations shown on the website are taken from the carriers and remain indicative.
The Customer receives a tracking number allowing them to locate the parcel at any time. In the event of abnormal delay, the Seller assists with the carrier and, where appropriate, files a claim.
This clause does not affect the Consumer's statutory rights. In accordance with the law, where the Customer is a Consumer and no time limit has been agreed, delivery takes place within a maximum of thirty (30) days from conclusion of the contract. Failing this, the Consumer may require the Seller to deliver within an additional reasonable period and, should that period also pass without delivery, terminate the contract and obtain a full refund of the sums paid.
7.4 Receipt and reservations
Risk of loss or damage passes when the Customer, or a third party designated by them, takes physical possession of the goods.
It is for the Customer to check the condition of the parcel on receipt. Where a parcel is visibly damaged or opened, or where its weight does not match the delivery note, we recommend recording written reservations with the carrier and informing us promptly, enclosing photographs. The absence of reservations does not deprive the Consumer of their statutory rights but makes proof more difficult.
7.5 Failed delivery
Where the Customer is repeatedly absent, or fails to collect a parcel from a pick-up point within the allotted time, the parcel is returned to us. A further shipment may be arranged at the Customer's expense.
Article 8 — Pre-orders and items on order
8.1 Nature of pre-orders
A pre-order relates to a product not yet released. The announced release date comes from the publisher or manufacturer and is communicated for guidance only. It may be brought forward, postponed or cancelled by the publisher without the Seller incurring liability.
The pre-order price is the one displayed on the day of the order. It is not revised upwards should the supplier's tariff subsequently increase, nor downwards should it decrease.
8.2 Postponed release
Where a release date is postponed, the Customer is informed. They retain the right to cancel the pre-order at any time before dispatch and obtain a full refund of the sums paid, without penalty and without giving reasons.
8.3 Definitive unavailability
Should a pre-ordered or specially ordered item become definitively unavailable, in particular where the publisher cancels the release or our supplier defaults, the order is cancelled as of right. The Customer is informed and refunded in full within a maximum of fourteen (14) days from the point at which unavailability is established, without having to request it.
An equivalent alternative may be offered; acceptance is entirely free and does not affect the right to a refund.
8.4 Availability and failure to collect
On receipt of the item, the Seller informs the Customer using the contact details given when ordering.
Where the item is to be collected in store, the Customer has one (1) month from that notification to collect it. As the order is paid in full, no balance is due at that point.
After that period, and following two attempts to make contact that go unanswered, the Seller contacts the Customer to arrange either shipment at the Customer's expense or a refund. No sum is retained by the Seller on account of a mere failure to collect.
This option does not affect the rights the Consumer holds under Articles 9 and 10.
8.5 Quantity limits
Given the limited nature of certain editions, we reserve the right to cap the number of units per Customer and per reference. Any order exceeding that limit may be reduced to the permitted quantity, with the balance refunded.
Article 9 — Right of withdrawal
9.1 Principle
The Consumer has fourteen (14) calendar days to withdraw, without giving reasons and without bearing costs other than those set out below.
The period runs from the day on which the Consumer, or a third party designated by them, takes physical possession of the goods. Where an order covers several goods delivered separately, the period runs from receipt of the last item.
9.2 Exercise
To exercise this right, the Consumer notifies us of their decision by an unambiguous statement sent to info@stoatcg.be or by post to the address given in Article 1. They may use the model form set out in the annex, though this is not compulsory.
To meet the deadline, it is sufficient that the notification be sent before the fourteen-day period expires.
9.3 Return of goods
The Consumer returns the goods without undue delay and no later than fourteen (14) days after notifying their withdrawal.
The direct cost of returning the goods is borne by the Consumer, unless we agree otherwise. We recommend a tracked service: proof of return lies with the Consumer.
9.4 Diminished value
The Consumer may handle the goods only as far as necessary to establish their nature, characteristics and functioning, as they would be able to do in a shop.
They are liable for any diminished value resulting from handling beyond that.
For unopened products — displays, boosters, boxed sets, decks — market value rests solely on the integrity of the original packaging. A product whose original packaging has been opened or damaged can no longer be resold: its contents are random and individualised by nature, and its residual value is nil.
Accordingly, the refund for a product whose original packaging has been opened is reduced to zero, the diminution observed amounting to the whole of the price. The Consumer keeps the right to notify withdrawal and return the goods; no sum is however refunded in that case.
This provision does not deprive the Consumer of the right of withdrawal: it draws its financial consequences, in line with the rule that the Consumer is liable for the diminished value of the goods.
9.5 Refund
We refund all sums received, including the initial standard delivery costs, no later than fourteen (14) days after notification of the withdrawal.
We may withhold the refund until we have received the goods back, or until the Consumer has supplied evidence of having sent them back, whichever occurs first.
The refund is made using the same means of payment as the initial transaction, unless expressly agreed otherwise. It incurs no charge for the Consumer.
Where the Consumer has chosen a more expensive delivery method than the standard one offered, the additional cost is not refunded.
9.6 Exceptions
In accordance with the law, the right of withdrawal does not apply in particular to goods made to the Consumer's specifications or clearly personalised, nor to goods which, after delivery and by their nature, become inseparably mixed with other items.
Sales concluded in a physical shop are not subject to the right of withdrawal, which is specific to distance selling.
Article 10 — Legal guarantee of conformity
10.1 Scope
As against the Consumer, the Seller is liable for any lack of conformity existing at the time of delivery and becoming apparent within two (2) years of that delivery.
Any lack of conformity becoming apparent within one (1) year of delivery is presumed to have existed at that time, unless proved otherwise or unless that presumption is incompatible with the nature of the goods.
10.2 Procedure
The Consumer informs the Seller of the defect within a reasonable time of discovering it. They may, under the conditions laid down by law, obtain repair or replacement of the goods and, failing that, a price reduction or termination of the contract.
Claims are sent to info@stoatcg.be, together with proof of purchase and, where possible, photographs of the defect.
10.3 Specific points relating to trading cards
The following do not constitute a lack of conformity:
- the random distribution of cards within an unopened product, nor the absence of a particular card, rarity or artwork, which is a matter of chance organised by the publisher;
- minor variations in centring, cutting or printing inherent in industrial manufacturing, provided they do not exceed the publisher's usual tolerances;
- any change in the market value of a card or product after purchase.
Conversely, an unopened product with incomplete contents, packaging damaged on arrival, or contents manifestly not matching the description do fall within the guarantee and must be reported to us.
Article 11 — Limitation of liability
The Seller takes reasonable steps to ensure the accuracy of the information published and the quality of the goods delivered.
The Seller cannot be held liable:
- for indirect loss arising from abnormal or unusual use of the goods, or use contrary to their intended purpose;
- for defects attributable to a third party, to force majeure, or to the Customer's own act;
- for temporary unavailability of the website, or for the consequences of an interruption of communication networks.
Some products carry age recommendations set by the publisher. It is for the Customer to observe them.
These limitations apply neither in cases of the Seller's wilful misconduct or gross negligence, nor where life, physical integrity or health is affected, nor where they would deprive the Consumer of the rights held under Articles 9, 10 and 15, from which no derogation is possible.
Article 12 — Force majeure
The Seller is not liable for failure or delay in performing its obligations resulting from an event of force majeure, including: natural disaster, fire, epidemic, armed conflict, strike, blockage or disruption of transport, power failure, failure of telecommunications or internet networks, decision of a public authority, customs blockage, delay or default of a supplier, publisher or manufacturer, or prolonged unavailability of staff.
In such cases, the Seller informs the Customer as soon as possible. Where the impediment is permanent, the order is cancelled and the Customer refunded in full.
Article 13 — Personal data
Data collected when ordering is necessary for processing the order, delivery, invoicing and compliance with the Seller's legal and accounting obligations.
It is processed in accordance with Regulation (EU) 2016/679 (GDPR). The Customer has rights of access, rectification, erasure, restriction, objection and portability, exercisable by writing to info@stoatcg.be.
Data is passed only to those providers strictly necessary for performance of the contract — payment provider, carrier, host — and is never transferred for commercial purposes.
The Customer has the right to lodge a complaint with the Belgian Data Protection Authority (Rue de la Presse 35, 1000 Brussels).
Article 14 — Intellectual property
All elements of the website — structure, texts, logo, graphic identity — are protected and remain the property of the Seller. Any reproduction, even partial, is prohibited without prior written authorisation.
Trade marks, logos, images and product names belong to their respective holders. They are reproduced solely to describe the products offered for sale and confer no right on the Customer.
The Seller is not affiliated with any publisher or manufacturer, save where expressly stated.
Article 15 — Complaints and dispute resolution
Complaints are addressed in the first instance to info@stoatcg.be. We undertake to reply within a reasonable time and to seek an amicable solution.
Failing amicable settlement, the Consumer may refer the matter free of charge to the Belgian Consumer Mediation Service (Boulevard du Roi Albert II 8 box 1, 1000 Brussels — www.consumerombudsman.be), or to the European online dispute resolution platform at ec.europa.eu/consumers/odr.
Article 16 — Governing law and jurisdiction
These terms are governed by Belgian law.
In the event of a dispute, the courts of the district of the Seller's registered office have sole jurisdiction. This clause does not affect the Consumer's right to bring proceedings before the courts of their own domicile, in accordance with applicable mandatory rules.
Article 17 — Severability
Should any provision of these terms be held void or unenforceable, the remaining provisions retain full effect.
Annex — Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract.
